Studio Pulse Terms of Service

Please read these Terms of Service (“Agreement”, “Terms of Service”) carefully before using www.studiopulse.com (“the Site”) operated by Studio Pulse, LLC (“us”, “we”, or “our”). This Agreement sets forth the legally binding terms and conditions for your use of the Site.

By accessing or using the Site in any manner, including but not limited to visiting or browsing the Site or contributing content or other materials, you agree to be bound by these Terms of Service. Capitalized terms are defined in this Agreement. These Terms of Service set forth the legally binding terms for your use of Studio Pulse services. You are only authorized to use Studio Pulse services (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and these Terms of Service.

Please read these Terms carefully and save them. If you do not agree, you must discontinue use of the Studio Pulse website and services immediately. If you wish to become a Member, you must read and accept these Terms during the registration process.

 

ACCOUNTS

To access certain features of the website, you must create a Studio Pulse account. You may not use another person’s account without permission. When creating an account, you must provide accurate and complete information.

You are solely responsible for activity that occurs under your account and must keep your password secure. You must notify us immediately of any unauthorized use or breach of security.

 

MEMBER SERVICES AND POLICIES

Cancellations

Reformer class reservations and waitlist cancellations must be made at least 8 hours prior to the start of class.

If you join a waitlist, monitor your email and account for updates up to 8 hours before class. If you are moved into a class, we assume attendance unless you cancel at least 8 hours in advance.

Reservations

You must be physically present at the start of your scheduled class or your spot may be released to a waitlisted client.

Membership Packages

Members with Monthly Unlimited memberships are subject to penalty charges for late cancellations or no-shows occurring within the 8-hour window.

Personal Belongings

Studio Pulse is not responsible for the safekeeping of personal belongings. You assume all risk of loss.

Free Classes

Cancellation policies and no-show fees apply to free classes. Failure to attend may result in being charged the full price of a single class.

 

STUDIO RULES AND REGULATIONS

  • All classes and memberships are non-refundable. No exceptions.

  • All classes must be prepaid.

  • You must be checked in at class start or your spot may be released.

  • Classes must be canceled or changed at least 8 hours in advance or are forfeited.

  • Membership packages are subject to late cancel and no-show penalties.

  • Notify the instructor before class if recovering from injury or illness.

  • Instructors and schedules may change without notice. Check the live schedule online.

  • Payments accepted: VISA, MASTERCARD, AMERICAN EXPRESS.

 

LIMITATION OF LIABILITY

I, the Participant, affirm that I am in good physical condition and do not suffer from any condition that would prevent or limit my participation in training with an independent contractor fitness instructor at Studio Pulse, LLC (“Studio Pulse” or “the Company”).

I confirm that I have no health conditions that may affect participation, including but not limited to cardiac irregularities, injuries, dizziness, asthma, diabetes, epilepsy, or allergies. If uncertain, I will consult a physician prior to participation.

I understand I am voluntarily participating in strenuous physical activity using reformers, floor exercise, weights, bands, and other equipment.

By signing this agreement, enrolling online, or attending classes, events, or programs in person or online, I acknowledge:

  • There are inherent risks in physical exercise

  • I voluntarily participate

  • Adverse events may occur including abnormal blood pressure, fainting, heart attack, or death

I assume all risk and release Studio Pulse, its instructors, contractors, employees, and clients from any responsibility, cost, or damages resulting from participation.

Minors

  • No one under age 15 may participate.

  • Ages 15–18 may participate only with a parent or legal guardian present.

  • This release applies to minors.

Pregnancy

If pregnant, I acknowledge additional risks and will consult a physician before participating.

COVID-19 / Infectious Disease Liability

Studio Pulse implements preventative measures but cannot guarantee you will not be exposed to illness. Participation may involve close contact with others and increased exposure risk.

You voluntarily assume all risks related to illness, injury, disability, or death resulting from attendance or participation.

You agree not to hold Studio Pulse liable for claims related to illness exposure, including COVID-19.

Studio Pulse reserves the right to refuse participation if an individual’s health may be endangered.

Participants must follow instructor directions at all times. Instructor guidance does not constitute medical advice.

 

CONTENT

All content on the Studio Pulse website, including text, graphics, photos, videos, and trademarks (“Content”), is owned by or licensed to Studio Pulse and protected by intellectual property law.

Content is for personal use only and may not be copied, distributed, or exploited without written permission.

Any feedback provided becomes the property of Studio Pulse.

You agree not to interfere with website security or restrictions.

“Studio Pulse,” related logos, graphics, and branding are trademarks of Studio Pulse and may not be used without permission.

 

MOBILE SERVICES

Studio Pulse may offer mobile services including booking, messaging, and app features. We do not charge for these services, but carrier messaging and data fees may apply.

By using mobile services, you consent to receiving communications via SMS or electronic messaging.

 

TERMINATION

We may terminate your access without notice, which may result in forfeiture of account information. Provisions that should survive termination will remain in effect.

 

THIRD-PARTY SITES

The Site may link to third-party websites not controlled by Studio Pulse. We are not responsible for their content or policies.

 

GOVERNING LAW

This Agreement is governed by the laws of Harris County, Texas, USA, without regard to conflict of law principles.

 

CHANGES TO TERMS

We may modify these Terms at any time by posting updates on the Site. Continued use constitutes acceptance.

 

ELIGIBILITY

Users must be at least 13 years old. Minors 13–18 may register only with parent or guardian involvement.

 

TERM

These Terms remain in effect while you use Studio Pulse services or hold membership. Membership may be terminated at any time per account instructions or by contacting the studio. Studio Pulse may terminate membership for violations.

 

FEES

Studio Pulse charges service fees and may change pricing at any time. No refunds are guaranteed if membership is terminated due to violation of Terms.

 

PASSWORD

You are responsible for password confidentiality and all account activity. Notify us immediately of unauthorized use.

 

INTELLECTUAL PROPERTY

All Studio Pulse content, programming, designs, and materials are proprietary and may not be used without permission.

 

ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and legal notices, constitute the entire agreement. Invalid provisions do not affect remaining provisions.

 

ARBITRATION

All disputes shall be resolved through binding arbitration, except where intellectual property or injunctive relief is involved.
